제10조의3(영주자격) ① 제10조제2호에 따른 영주자격(이하 "영주자격"이라 한다)을 가진 외국인은 활동범위 및 체류기간의 제한을 받지 아니한다. ② 영주자격을 취득하려는 사람은 대통령령으로 정하는 영주의 자격에 부합한 사람으로서 다음 각 호의 요건을 모두 갖추어야 한다. 1. 대한민국의 법령을 준수하는 등 품행이 단정할 것 2. 본인 또는 생계를 같이하는 가족의 소득, 재산 등으로 생계를 유지할 능력이 있을 것 3. 한국어능력과 한국사회ㆍ문화에 대한 이해 등 대한민국에서 계속 살아가는 데 필요한 기본소양을 갖추고 있을 것 ③ 법무부장관은 제2항제2호 및 제3호에도 불구하고 대한민국에 특별한 공로가 있는 사람, 과학ㆍ경영ㆍ교육ㆍ문화예술ㆍ체육 등 특정 분야에서 탁월한 능력이 있는 사람, 대한민국에 일정금액 이상을 투자한 사람 등 대통령령으로 정하는 사람에 대해서는 대통령령으로 정하는 바에 따라 제2항제2호 및 제3호의 요건의 전부 또는 일부를 완화하거나 면제할 수 있다. ④ 제2항 각 호에 따른 요건의 기준ㆍ범위 등에 필요한 사항은 법무부령으로 정한다.
제33의2조 (영주증 재발급에 관한 특례 등) · 출입국관리법
제33조의2(영주증 재발급에 관한 특례 등) ① 제33조에도 불구하고 이 법(법률 제15492호 출입국관리법 일부개정법률을 말한다. 이하 이 조에서 같다) 시행 당시 종전의 규정에 따라 영주자격을 가진 사람은 다음 각 호의 구분에 따른 기간 내에 체류지 관할 지방출입국ㆍ외국인관서의 장에게 영주증을 재발급받아야 한다. 1. 이 법 시행 당시 영주자격을 취득한 날부터 10년이 경과한 사람: 이 법 시행일부터 2년 이내 2. 이 법 시행 당시 영주자격을 취득한 날부터 10년이 경과하지 아니한 사람: 10년이 경과한 날부터 2년 이내 ② 체류지 관할 지방출입국ㆍ외국인관서의 장은 제1항 각 호에 해당하는 사람에게 영주증 재발급 신청기한 등이 적힌 영주증 재발급 통지서를 지체 없이 송부하여야 한다. 다만, 소재불명 등으로 영주증 재발급 통지서를 송부하기 어려운 경우에는 관보에 공고하여야 한다. ③ 제33조제3항에도 불구하고 이 법 시행 당시 종전의 규정에 따라 영주자격을 가진 사람의 영주증은 제1항에 따라 영주증을 재발급받기 전까지 유효한 것으로 본다. ④ 제1항에 따른 영주증의 재발급 절차 등에 필요한 사항은 대통령령으로 정한다.
제89의2조 (영주자격의 취소 특례) · 출입국관리법
제89조의2(영주자격의 취소 특례) ① 법무부장관은 영주자격을 가진 외국인에 대해서는 제89조제1항에도 불구하고 다음 각 호의 어느 하나에 해당하는 경우에 한정하여 영주자격을 취소할 수 있다. 다만, 제1호에 해당하는 경우에는 영주자격을 취소하여야 한다. 1. 거짓이나 그 밖의 부정한 방법으로 영주자격을 취득한 경우 2. 「형법」, 「성폭력범죄의 처벌 등에 관한 특례법」 등 법무부령으로 정하는 법률에 규정된 죄를 범하여 2년 이상의 징역 또는 금고의 형이 확정된 경우 3. 최근 5년 이내에 이 법 또는 다른 법률을 위반하여 징역 또는 금고의 형을 선고받고 확정된 형기의 합산기간이 3년 이상인 경우 4. 대한민국에 일정금액 이상 투자 상태를 유지할 것 등을 조건으로 영주자격을 취득한 사람 등 대통령령으로 정하는 사람이 해당 조건을 위반한 경우 5. 국가안보, 외교관계 및 국민경제 등에 있어서 대한민국의 국익에 반하는 행위를 한 경우 ② 법무부장관은 제1항에 따라 영주자격을 취소하는 경우 대한민국에 계속 체류할 필요성이 인정되고 일반체류자격의 요건을 갖춘 경우 해당 외국인의 신청이 있는 때에는 일반체류자격을 부여할 수 있다. ③ 제1항에 따라 영주자격을 취소하는 경우에는 제89조제2항 및 제3항을 준용한다.
