Birth Registration in Korea as a Foreigner: What to Do Within 1 Month
A foreigner (or foreign-Korean couple) has had a child born in Korea and needs to register the birth with Korean authorities. This guide covers the legal deadline, required documents, and step-by-step process.

What Korean law says
- ·Art. 44①: Birth must be registered within 1 month of birth.
- ·Art. 44②: The registration form must include the child's name, family origin (본), gender, registration base address; whether born in or out of wedlock; date/time/place of birth; parents' names, family origin, registration base address, and Resident Registration Number (or, if a parent is a foreigner: name, date of birth, nationality, and Alien Registration Number); and whether the child holds multiple nationalities and which foreign nationality was acquired.
- ·Art. 44③: The child's name must be written in Korean (한글) or commonly used Chinese characters (한자) as defined by Supreme Court rules.
- ·Art. 44④: A birth certificate (출생증명서) issued by a doctor or midwife must be attached to the registration form.
- ·Art. 44-2①: If no birth certificate can be attached, the registrant must first obtain a birth confirmation from the Family Court, then file within 1 month of receiving that confirmation.
- ·Art. 44-4①②③: The local office verifies whether registration was made within the deadline. If not, it issues a formal 7-day notice to the obligated registrant. If still not filed, it may record the birth ex officio with supervisory court permission.
- ·Art. 45①: Registration may be filed at the place of birth.

Common mistakes
- ·Waiting too long: missing the 1-month deadline triggers a formal warning (최고) from the local office and potential ex-officio recording (Art. 44-4②③) — do not delay.
- ·Not attaching the birth certificate: the birth certificate from the doctor/midwife is mandatory (Art. 44④); registration cannot proceed without it (or a Family Court confirmation in lieu).
- ·Writing the child's name incorrectly: the name must be in Korean (한글) or approved Chinese characters (한자) only — other scripts are not accepted (Art. 44③).
- ·Forgetting to note dual nationality: if the child holds a foreign nationality at birth, this must be declared on the form (Art. 44②⑥); omitting it can cause complications later.
- ·Confusing Korean registration with home-country registration: the Korean birth registration and your home country's consular registration are two separate obligations.
- ·Not including the Alien Registration Number of the foreign parent: this is a mandatory field when a parent is a foreigner (Art. 44②④).

제44조 (출생신고의 기재사항) · 가족관계의 등록 등에 관한 법률
제44조(출생신고의 기재사항) ① 출생의 신고는 출생 후 1개월 이내에 하여야 한다. ② 신고서에는 다음 사항을 기재하여야 한다. 1. 자녀의 성명ㆍ본ㆍ성별 및 등록기준지 2. 자녀의 혼인 중 또는 혼인 외의 출생자의 구별 3. 출생의 연월일시 및 장소 4. 부모의 성명ㆍ본ㆍ등록기준지 및 주민등록번호(부 또는 모가 외국인인 때에는 그 성명ㆍ출생연월일ㆍ국적 및 외국인등록번호) 5. 「민법」 제781조제1항 단서에 따른 협의가 있는 경우 그 사실 6. 자녀가 복수국적자(複數國籍者)인 경우 그 사실 및 취득한 외국 국적 ③ 자녀의 이름에는 한글 또는 통상 사용되는 한자를 사용하여야 한다. 통상 사용되는 한자의 범위는 대법원규칙으로 정한다. ④ 출생신고서에는 의사나 조산사가 작성한 출생증명서를 첨부하여야 한다. 다만, 다음 각 호의 어느 하나에 해당하는 서면을 첨부하는 경우에는 그러하지 아니하다. 1. 분만에 직접 관여한 자가 모의 출산사실을 증명할 수 있는 자료 등을 첨부하여 작성한 출생사실을 증명하는 서면 2. 국내 또는 외국의 권한 있는 기관에서 발행한 출생사실을 증명하는 서면 3. 모의 출산사실을 증명할 수 있는 「119구조ㆍ구급에 관한 법률」 제22조에 따른 구조ㆍ구급활동상황일지 ⑤ 제4항 단서에 따라 첨부하는 서면에 관한 구체적인 사항은 대법원규칙으로 정한다.
제44의2조 (출생증명서가 없는 경우의 출생신고) · 가족관계의 등록 등에 관한 법률
제44조의2(출생증명서가 없는 경우의 출생신고) ① 제44조제4항에 따른 출생증명서 또는 서면을 첨부할 수 없는 경우에는 가정법원의 출생확인을 받고 그 확인서를 받은 날부터 1개월 이내에 출생의 신고를 하여야 한다. ② 가정법원은 제1항의 출생확인을 위하여 필요한 경우에는 직권으로 사실을 조사할 수 있으며, 지방자치단체의 장, 국가경찰관서의 장 등 행정기관이나 그 밖에 상당하다고 인정되는 단체 또는 개인에게 필요한 사항을 보고하게 하거나 자료의 제출을 요청할 수 있다. ③ 가정법원의 출생확인 절차와 신고에 필요한 사항은 대법원규칙으로 정한다.
제44의4조 (출생신고의 확인ㆍ최고 및 직권 출생 기록) · 가족관계의 등록 등에 관한 법률
제44조의4(출생신고의 확인ㆍ최고 및 직권 출생 기록) ① 제44조의3제3항에 따른 통보를 받은 시ㆍ읍ㆍ면의 장은 제44조제1항에 따른 신고기간 내에 출생자에 대한 출생신고가 되었는지를 확인하여야 한다. ② 시ㆍ읍ㆍ면의 장은 제44조제1항에 따른 신고기간이 지나도록 제44조의3제3항에 따라 통보받은 출생자에 대한 출생신고가 되지 아니한 경우에는 즉시 제46조제1항 및 제2항에 따른 신고의무자에게 7일 이내에 출생신고를 할 것을 최고하여야 한다. ③ 시ㆍ읍ㆍ면의 장은 다음 각 호의 어느 하나에 해당하는 경우 제44조의3제3항에 따라 통보받은 자료를 첨부하여 감독법원의 허가를 받아 해당 출생자에 대하여 직권으로 등록부에 출생을 기록하여야 한다. 1. 제46조제1항 및 제2항에 따른 신고의무자가 제2항의 최고기간 내에 출생신고를 하지 아니한 경우 2. 제46조제1항 및 제2항에 따른 신고의무자를 특정할 수 없는 등의 이유로 제2항에 따라 신고의무자에게 최고할 수 없는 경우 ④ 제1항부터 제3항까지에서 규정한 사항 외에 출생신고 확인, 출생신고 최고, 출생자의 성명ㆍ본 및 등록기준지의 결정 방법 등에 관하여 필요한 사항은 대법원규칙으로 정한다.
